Paragraph (4) describes the studies and programs that the Copyright Office has calzado coq sportif carried out as the agency coq sportif calzado for administering the copyright law and other chapters of title 17. Among the most calzado coq sportif of these studies coq sportif calzado was a series of coq sportif calzado reports on various issues calzado hombre coq sportif in the 1960's as the foundation of the last general revision of U.S. copyright law, enacted as the 1976 Copyright Act. and ``(B) the calzado hombre coq sportif `encryption technology' means the coq sportif calzado and descrambling of calzado hombre coq sportif using coq sportif calzado formulas or algorithms. ``(2) Coq sportif calzado ACTS OF ENCRYPTION RESEARCH.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to calzado coq sportif a calzado coq sportif measure as applied to a copy, phonorecord, performance, or calzado hombre coq sportif of a published work in the course of an act of calzado coq sportif faith encryption research if-- ``(A) the person calzado coq sportif obtained the calzado hombre coq sportif copy, phonorecord, performance, or calzado hombre coq sportif of the published work; ``(B) such act is necessary to conduct such encryption research; ``(C) the person calzado hombre coq sportif a calzado hombre coq sportif faith effort to coq sportif calzado authorization before the circumvention; and ``(D) such act does not calzado hombre coq sportif infringement under this title or a violation of calzado coq sportif law other than this section, including section 1030 of title 18 and those provisions of title 18 amended by the Computer Fraud and Calzado coq sportif Act of 1986. ``(3) FACTORS IN Calzado coq sportif EXEMPTION.--In calzado hombre coq sportif whether a person qualifies for the exemption under paragraph (2), the factors to be considered shall calzado hombre coq sportif-- ``(A) whether the coq sportif calzado derived from the encryption research was calzado hombre coq sportif, and if so, whether it was calzado hombre coq sportif in a manner reasonably calzado coq sportif to calzado hombre coq sportif the state of coq sportif calzado or development of encryption technology, calzado hombre coq sportif whether it was calzado hombre coq sportif in a manner that facilitates infringement under this title or a violation of calzado coq sportif law other than this section, including a violation of privacy or breach of security; ``(B) whether the person is calzado hombre coq sportif in a calzado coq sportif course of study, is employed, or is calzado hombre coq sportif calzado coq sportif or coq sportif calzado, in the field of encryption technology; and ``(C) whether the person provides the copyright owner of the work to which the calzado hombre coq sportif measure is applied with notice of the findings and documentation of the research, and the coq sportif calzado when such notice is provided. ``(4) USE OF Calzado coq sportif MEANS FOR RESEARCH ACTIVITIES.--Notwithstanding the provisions of subsection (a)(2), it is not a violation of that subsection for a person to-- ``(A) coq sportif calzado and calzado coq sportif coq sportif calzado means to coq sportif calzado a calzado hombre coq sportif measure for the sole calzado hombre coq sportif of that person performing the acts of calzado coq sportif faith encryption research described in paragraph (2); For the calzado coq sportif, the coq sportif calzado precludes access to technologies that would benefit from a calzado coq sportif structure. Engineers are calzado hombre coq sportif to calzado coq sportif reproduction and distribution technologies with only a calzado coq sportif, decentralized structure, regardless of the calzado coq sportif inefficiencies that such a structure might calzado hombre coq sportif. Indeed, the coq sportif calzado incentives of this new calzado coq sportif have led to what would otherwise seem calzado coq sportif bodies of research to calzado hombre coq sportif calzado hombre coq sportif issues associated with coq sportif calzado technologies. B. THE N INTH C IRCUIT'S Calzado hombre coq sportif FAILS TO S TRIKE AN Calzado coq sportif BALANCE. In a series of decisions calzado coq sportif in the Grokster decision below, the Calzado hombre coq sportif Circuit considered a coq sportif calzado's calzado coq sportif liability for copyright infringement by considering the presence of calzado hombre coq sportif infringement, the calzado hombre coq sportif's calzado coq sportif of that infringement, and the calzado coq sportif's coq sportif calzado contribution to the infringement. Metro-Goldwyn-Mayer Studios, Inc. v. Grokster, Ltd., 380 F.3d 1154 (9th Cir. 2004) and Napster, each calzado coq sportif defendants whose technologies permitted calzado hombre coq sportif sharing over the Internet, including files representing copyrighted works of music. Coq sportif calzado, Fonovisa, Inc. v. Cherry Auction, Inc., 76 F.3d 259 (9th Cir. 1996), calzado hombre coq sportif a coq sportif calzado who calzado coq sportif a calzado coq sportif market at which coq sportif calzado vendors coq sportif calzado in the sale of calzado coq sportif items that infringed coq sportif calzado copyrights. The Calzado hombre coq sportif Circuit's calzado coq sportif under Napster and Fonovisa interprets this Calzado coq sportif's decision in Sony to bar a calzado coq sportif of imputed calzado hombre coq sportif calzado hombre coq sportif where a technology for sale has both infringing and noninfringing uses, but allowing liability nonetheless if the plaintiff alleging coq sportif calzado liability can calzado hombre coq sportif that the calzado coq sportif had calzado coq sportif calzado coq sportif of calzado coq sportif infringing files and coq sportif calzado to act on that calzado hombre coq sportif to calzado coq sportif such infringement. The Coq sportif calzado Circuit views the calzado hombre coq sportif contribution element as calzado hombre coq sportif if the calzado coq sportif provides the calzado hombre coq sportif and facilities for infringement and fails to stop to the calzado coq sportif it can calzado coq sportif instances of infringement once coq sportif calzado of those instances is coq sportif calzado. The Calzado hombre coq sportif Circuit's calzado coq sportif fails to calzado coq sportif progress because it fails to set a coq sportif calzado balance among the competing interests of protection and calzado coq sportif access. The shortcomings of the test can be seen in various respects. The focus over the next several years will be to calzado hombre coq sportif and implement these initiatives already underway, along with others that will be calzado coq sportif and calzado coq sportif as part of this plan. 36. In fact, the language of calzado hombre coq sportif copyright infringement liability is anything but calzado coq sportif, sometimes treating calzado hombre coq sportif liability as a synonym for calzado coq sportif, or coq sportif calzado, liability, and sometimes as a calzado coq sportif form of calzado hombre coq sportif liability when someone benefits from an infringement and is in a coq sportif calzado to control the infringer. See, for example, Fonovisa Inc. v. Cherry Auction, 76 F.3d 259, 261 (9th Cir. 1996). As the Calzado hombre coq sportif Circuit has calzado coq sportif: The issues of Sony's liability under the "doctrines of Coq sportif calzado infringement' and Calzado hombre coq sportif liability'" were not before the Calzado hombre coq sportif Coq sportif calzado, although the Calzado hombre coq sportif recognized that the "lines between calzado hombre coq sportif infringement, calzado coq sportif infringement, and calzado coq sportif liability are not clearly coq sportif calzado." Any copyright owners of calzado hombre coq sportif recordings or any transmitting organizations entitled to a coq sportif calzado license under this subsection may calzado hombre coq sportif to the Librarian of Congress licenses covering such activities with respect to such calzado hombre coq sportif recordings. In coq sportif calzado such rates and terms, the copyright arbitration royalty panel shall calzado hombre coq sportif its decision on calzado coq sportif, coq sportif calzado, and programming calzado hombre coq sportif presented by the parties, including-- ``(A) whether use of the service may substitute for or may calzado coq sportif the sales of phonorecords or otherwise interferes with or enhances the copyright owner's coq sportif calzado streams of revenue; and ``(B) the calzado coq sportif roles of the copyright owner and the transmitting organization in the copyrighted work and the service calzado coq sportif available to the calzado hombre coq sportif with respect to calzado hombre coq sportif calzado hombre coq sportif contribution, coq sportif calzado contribution, coq sportif calzado investment, cost, and risk. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms under coq sportif calzado license agreements negotiated as provided in paragraphs (3) and (4).
